Legal clinic on civil liberties: projects for 2018-2019

The 2018-2019 academic year saw the consolidation of the legal clinic specializing in civil liberties through the creation of new partnerships, notably with the Grenoble-Alpes Métropole urban community, the ComUE (Communauté Université Grenoble-Alpes) and the association. Planet Refugees-Human RightsOur long-standing partnerships (the city of Grenoble, the Grenoble Bar Association's Human Rights Institute, and the Alliance of Lawyers for Human Rights) have also been strengthened.

For the 2018–2019 academic year, the legal clinic handled 7 projectsThe students in the Master 2 program in Fundamental Rights Litigation were divided into groups for the various projects, and a few students from the Master 1 program in Civil Liberties were also involved in the work.

Each project is carried out in partnership with legal practitioners (lawyers, jurists, human rights consultants) who supervise the students. The students are also supervised by academics.

The students' work is carried out within the framework of partnerships based on trust and confidentiality. For this reason, certain information is confidential.

Actions implemented

1. The "Mobile Legal Team" project

This innovative scheme, which is unique in France, aims to provide a legal remedy for non-use of the enforceable right to housing (DALO) and the enforceable right to accommodation (DAHO), while strengthening existing support measures for the public. This experiment should make it possible to improve the identification and support of people in need of accommodation or housing, but also to answer administrative and legal questions relating to the preparation of a DALO/DAHO appeal file that arise for professionals or volunteers, associations or institutions supporting the people concerned.

March 4, 2019: Grenoble Appeal
On the eve of the 12th anniversary of the DALO law (enforceable right to housing), Grenoble City Hall welcomed representatives from the accommodation and housing sector, in the presence of Mayor Éric Piolle, who together launched an appeal to "uphold the rights of homeless people." The Faculty of Law, involved in the Grenoble EJM project with the legal clinic specializing in civil liberties, was present to support this appeal with students from the Master 2 "Fundamental Rights Litigation" program, who are handling the legal aspects of the project.

2. A contentious project concerning transgender people

Students are required to conduct legal research with a view to drafting pre-litigation and litigation documents aimed at asserting the rights of transgender people.

3. Participation in the development of general principles on the conditions of detention of prisoners sentenced to death

Students conduct legal research on this topic as part of an advocacy initiative.

February 25–27, 2019: participation of students involved in the project in the 7th World Congress Against the Death Penalty, active participation in the side event "Beyond Mandela's Rules." February 27–29, 2019Students from the civil liberties law clinic attended the World Congress Against the Death Penalty in Brussels to present the results of their work with the association Planète Réfugiés-Droits de l'Homme (Refugee Planet-Human Rights) as part of a panel bringing together French and foreign associations and lawyers. They also met with the European Union's focal point on the death penalty, to whom they submitted an advocacy brief. At the end of the Congress, a resolution presented by the Paris Bar Association and the International Bar Association was adopted. It was signed by more than 60 bar associations around the world, representing more than 30 different countries.

4. Participation in the Grenoble metropolitan area and Comue's discrimination monitoring and action groups

Students involved in the clinic actively participate in the monitoring groups of both partners.

March 19, 2019: signing of the "Partenaires-égalité" network charter of Grenoble-Alpes Métropole

The legal clinic specializing in civil liberties participated in the signing of the Grenoble-Alpes Métropole "Partenaires-égalité" network charter by the Université Grenoble Alpes Community Université Grenoble Alpes the Crous Grenoble Alpes, in the presence of Mr. Frédéric Potier, Interministerial Delegate for the Fight against Racism, Anti-Semitism, and Anti-LGBT Hate (Dilcrah).
The legal clinic specializing in civil liberties participates in the "inter-university unit for monitoring and combating discrimination" created by the Université Grenoble Alpes Community. This unit is based on a network of alert receivers who identify situations or receive reports from whistleblowers. With the support of a legal expert, students from the legal clinic assist the unit in assessing reports and determining the legal strategy to be adopted to resolve them.
The inter-university unit works in conjunction with existing mechanisms in universities (units combating gender-based or sexual violence, mechanisms combating discrimination, ethics committees, equality and anti-discrimination officers, etc.) and in partnership with the Grenoble-Alpes Métropole monitoring and action unit, the Defender of Rights, and associations that support the public (legal support, listening, etc.) such as LICRA and SOS Homophobie.
The unit's work to combat discrimination is complemented throughout the year by awareness-raising activities jointly organized by all university institutions and student associations, such as workshops, conferences, debates, meetings, communication campaigns, etc.

Students are required to conduct legal research with a view to drafting pre-litigation and litigation documents.
